1.1 This website at www.blinkfreight.com (the "Website") is operated by Blinkfreight Pte. Ltd., a company incorporated in Singapore (UEN 201811804G), with its registered office at 3 Raffles Place #06-01, Singapore 048617 ("Blinkfreight", "we", "us", "our").
1.2 These Terms of Use ("Terms") govern your access to and use of the Website, including any online forms, quotation tools, tracking pages or customer portals made available through it. By accessing or using the Website you agree to these Terms. If you do not agree, do not use the Website.
1.3 The Website is intended for business users. By using it you confirm that you are at least 18 years old and, where you act on behalf of a company or other organisation, that you are authorised to bind it to these Terms. In that case "you" includes that organisation.
1.4 The Website is not directed at persons in any jurisdiction where its content or our services would be unlawful or require a licence we do not hold.
2.1 Content on the Website is provided for general information only. Browsing the Website does not create any contractual relationship between you and Blinkfreight, and nothing on the Website is an offer capable of acceptance.
2.2 Schedules and transit times. Dates for departures and arrivals are shown in local date and time. All schedules, transit times and estimated times of departure or arrival are estimates only, are given without guarantee and may change without notice. Blinkfreight is not responsible for delays caused by weather, port congestion, transshipment, vessel or aircraft breakdown, carrier schedule changes, customs or other government action, or any other cause outside our reasonable control.
2.3 Rates and quotations. Any rate, price or quotation shown on or generated through the Website is indicative only and is not binding until confirmed by us in writing. Quotations are subject to space and equipment availability, carrier surcharges, currency movements and the terms referred to in section 3.
2.4 We take reasonable care to keep the Website accurate and current, but we do not warrant that any content is complete, accurate or up to date, and you should not rely on it without independent verification.
3.1 These Terms apply only to your use of the Website. Any freight forwarding, transport, warehousing, customs or other logistics services provided by Blinkfreight or its affiliates are provided exclusively under our Standard Trading Conditions (available on request), together with the terms of any bill of lading, air waybill or other transport document issued, and any written service agreement between you and us (together, the "Service Terms").
3.2 Services may be performed by Blinkfreight Pte. Ltd., by its affiliate Blinkfreight (Shanghai) International Forwarding Co., Ltd., or by other affiliates, agents or subcontractors. The entity named on the quotation, booking confirmation, invoice or transport document is the contracting party for that service.
3.3 If there is any conflict between these Terms and the Service Terms, the Service Terms prevail.
4.1 You must use the Website lawfully and in accordance with these Terms. You must not:
(a) use the Website for any unlawful, fraudulent or harmful purpose, or in breach of any applicable sanctions or export control law;
(b) upload, transmit or distribute any content that is defamatory, obscene, discriminatory, promotes violence or terrorism, or infringes the rights of any person;
(c) introduce viruses, malware or other harmful code, or attempt to gain unauthorised access to the Website, its servers or any connected system or network;
(d) interfere with or disrupt the operation of the Website, including by denial-of-service attacks or excessive automated requests;
(e) use any robot, scraper or other automated means to access, copy or extract content or data from the Website without our prior written consent;
(f) transmit content you have no right to transmit, including confidential information, inside information or material protected by intellectual property rights of third parties;
(g) send unsolicited advertising, spam, chain letters or similar communications through the Website; or
(h) reproduce, resell or commercially exploit any part of the Website without our prior written consent.
4.2 You are responsible for ensuring that any information you submit through the Website, including shipment details, is accurate, complete and lawful.
5.1 Some features may require a user account. You must keep your login credentials confidential, must not share them with unauthorised persons, and are responsible for all activity under your account.
5.2 You must notify us immediately at privacy@blinkfreight.com if you suspect any unauthorised access to your account.
5.3 We may suspend or disable any account, reset credentials, or restrict access to any feature at any time if we reasonably believe your account is compromised or you have breached these Terms.
6.1 The Website and all content on it, including text, graphics, logos, software, data compilations and page design, are owned by or licensed to Blinkfreight and are protected by copyright, trade mark and other intellectual property laws.
6.2 You may view and print pages of the Website for your internal business purposes only. No other right or licence is granted. You must not modify, copy, distribute, publish, reverse engineer or create derivative works from any part of the Website without our prior written consent.
6.3 "Blinkfreight" and our logos are our trade marks. You may not use them without our prior written consent.
6.4 If you believe content on the Website infringes your intellectual property rights, please contact us at privacy@blinkfreight.com with details of the material and your claim.
By submitting information through the Website (for example a quotation request or enquiry), you grant us the right to use that information to respond to you, to provide and improve our services, and as described in our Privacy Policy. You confirm that you have the right to provide that information, including any personal data of third parties such as shippers, consignees or contacts.
The Website may contain links to third-party websites, such as carrier or tracking sites. These links are provided for convenience only. We do not control and are not responsible for the content, availability or privacy practices of third-party websites, and a link does not imply any endorsement or relationship.
9.1 We may update, modify, suspend or remove any part of the Website at any time without notice. We do not guarantee that the Website will be available at all times or free from errors, interruptions or viruses.
9.2 The Website is designed for current versions of major web browsers. We are not responsible for any problem arising from the use of unsupported browsers, devices or configurations.
9.3 You are responsible for protecting your own systems with appropriate security measures and antivirus software.
To the maximum extent permitted by law, the Website and its content are provided "as is" and "as available", without any warranty of any kind, whether express or implied, including any warranty of accuracy, fitness for a particular purpose, non-infringement or uninterrupted availability.
11.1 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
11.2 Subject to section 11.1, Blinkfreight shall not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss or damage arising out of or in connection with your access to or use of (or inability to use) the Website or reliance on its content, including:
(a) any loss of profit, revenue, business, contracts, goodwill or anticipated savings;
(b) any loss or corruption of data;
(c) any damage to your computer systems caused by viruses or other harmful material; or
(d) any indirect, incidental, special or consequential loss.
11.3 Subject to section 11.1, our total aggregate liability arising out of or in connection with the Website and these Terms shall not exceed SGD 100.
11.4 This section 11 does not apply to liability arising under the Service Terms, which is governed exclusively by those terms.
You agree to indemnify Blinkfreight and its affiliates, officers and employees against all claims, losses, damages and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.

We may suspend or terminate your access to the Website at any time, without notice, if you breach these Terms. Sections 6, 10, 11, 12, 15 and 16 survive any termination.
15.1 These Terms, and any dispute or claim arising out of or in connection with them or the Website (including non-contractual disputes), are governed by the laws of the Republic of Singapore.
15.2 The courts of Singapore have exclusive jurisdiction to settle any such dispute, except that we may seek urgent injunctive or other interim relief in any court of competent jurisdiction.
15.3 Nothing in these Terms deprives you of the protection of any mandatory provision of the law of your country of residence that cannot be excluded by agreement.
16.1 Changes to these Terms. We may amend these Terms at any time by publishing a revised version on the Website. The revised Terms apply from the date of publication. Your continued use of the Website after that date constitutes acceptance of the revised Terms.
16.2 Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
16.3 No waiver. A failure or delay by us in exercising any right does not waive that right.
16.4 Assignment. We may transfer our rights and obligations under these Terms to any affiliate or successor. You may not assign your rights without our prior written consent.
16.5 Third-party rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any of its terms.
16.6 Language. These Terms are drafted in English. If they are translated, the English version prevails.
